Giveaway Terms & Conditions

1. Promotional Giveaway — No Obligation, No Employment

All Giveaways are offered for promotional and entertainment purposes only. Participation does not constitute a contract for services, employment, agency, partnership, joint venture, or any guarantee of payment. No reward is earned, owed, vested, or payable to any Participant unless and until it has actually been delivered to that Participant. We may, at our sole discretion, decline to issue any reward in whole or in part. No purchase or wagering is required to participate unless explicitly stated for a specific Giveaway.

2. Eligibility, Verification & Right to Refuse

Participants must be at least 18 years of age, or the legal age of majority in their jurisdiction, whichever is higher. Giveaways are void where prohibited, restricted, or regulated by applicable law, and Participants are solely responsible for ensuring their participation is lawful in their jurisdiction.

We reserve the right to verify the identity, age, eligibility, residence, and submission information of any Participant before, during, or after a Giveaway. If any required information is incomplete, inaccurate, unverifiable, misleading, inconsistent, or suspected to be fraudulent, entries may be voided and rewards may be delayed, reduced, withheld, or revoked.

We reserve the right, at our sole and absolute discretion, to refuse service, deny participation, void entries, disqualify any individual, and withhold or revoke any reward, at any time, for any reason or for no reason, with or without notice, and without explanation. No Participant has any right or expectation of being selected, paid, or continued in any Giveaway.

3. Fraud, Abuse & Fair Play

We reserve the right, at our sole discretion, to deny, modify, or revoke any Giveaway reward, in whole or in part, if we determine or suspect that a Participant has engaged in any of the following:

• Use of bots, automation, scripts, or artificial activity
• Use of alternate, duplicate, shared, or multiple accounts
• Submission of false, misleading, manipulated, or impersonated information
• Use of VPNs, proxies, or location-masking tools to evade eligibility rules
• Exploiting loopholes, bugs, or technical issues
• Coordinated entry, collusion, or vote-rigging with other Participants
• Harassment, threats, or abusive behavior toward staff, moderators, or community members
• Any deceptive, abusive, or unfair method to enter, participate in, or claim a reward

Attempts to circumvent these Terms may result in permanent disqualification from current and future Giveaways and forfeiture of any pending or previously issued reward.

4. Finality of Decisions

All Giveaway-related decisions — including but not limited to eligibility, verification, selection, qualification, reward amounts, timing of payout, method of payout, and disqualification — are final, binding, and made at our sole and absolute discretion. No appeal, arbitration of outcome, or external review is available.

5. Community Engagement & Giveaway Hunters

Giveaways are intended for genuine, engaged members of our community. We reserve the right, at our sole and absolute discretion, to identify any Participant as a “Giveaway Hunter” — including, without limitation, individuals who appear to participate primarily or solely to obtain rewards; who have minimal or no demonstrable engagement with our streams, Discord, social channels, or community; who participate in numerous unrelated giveaways across creators with little or no community involvement; who repeatedly claim without engaging; or who otherwise exhibit patterns consistent with reward farming.

Participants identified as Giveaway Hunters may, at our sole and absolute discretion and without explanation, have their entries voided, rewards withheld in whole or in part, payouts indefinitely delayed, eligibility revoked, and/or be permanently excluded from current and future Giveaways. Withholding payment to a Giveaway Hunter is not a breach of any obligation and creates no claim or right to compensation.

6. Modification, Suspension & Cancellation

We reserve the right to modify, suspend, postpone, restart, or cancel any Giveaway, any prize pool, any payout schedule, or these Terms at any time, for any reason, including but not limited to fraud prevention, technical issues, legal requirements, sponsor changes, or operational needs. Continued participation following any change constitutes acceptance of the change.

7. Technical, Platform & Delivery Limitations

We are not responsible for delayed, lost, misdirected, garbled, incomplete, or failed entries, submissions, claims, notifications, or payouts due to technical malfunctions, third-party services, platform outages, account issues, incorrect or outdated information, wallet issues, exchange or network downtime, blockchain congestion, or connectivity problems.

Giveaways are in no way sponsored, endorsed, administered by, or associated with Twitch, Kick, Discord, X (formerly Twitter), YouTube, Instagram, Rainbet, or any other third-party platform. Each Participant releases such platforms from any and all liability arising out of or related to any Giveaway.

8. Publicity, Likeness & Submitted Content

By participating, you grant us a worldwide, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, display, broadcast, distribute, and create derivative works of your publicly known username, submitted username, in-stream chat messages, and any text, image, or other content you voluntarily submit in connection with a Giveaway, for promotional, editorial, and operational purposes (including streams, websites, Discord servers, leaderboards, social media, and promotional materials), in any media now known or later developed.

You represent and warrant that any content you submit is yours to submit and does not infringe any third-party rights. You waive any moral rights and any right to inspect or approve any such use.

9. Cryptocurrency Rewards

Some rewards may be paid in cryptocurrency. By accepting a crypto reward, you acknowledge and agree that:

• Cryptocurrency values are volatile and may change before, during, or after payout
• Blockchain transactions are generally irreversible once sent
• You are solely responsible for providing a correct wallet address and selecting the proper network
• You represent that you are not a resident of, or located in, any country, territory, or region subject to comprehensive sanctions or trade restrictions (including without limitation jurisdictions designated by the U.S. Office of Foreign Assets Control (OFAC)), and that you are not on any applicable sanctions, denied-persons, or restricted-persons list
• We may require additional identification or verification before issuing a crypto reward and may decline to pay where we believe payout would violate applicable law
• We are not responsible for losses due to incorrect addresses, incompatible networks, third-party wallet services, blockchain failures, exchange failures, lost keys, or regulatory restrictions

10. Taxes, Fees & Reporting

Any applicable taxes, fees, gas costs, currency conversion costs, withholding obligations, or reporting obligations related to entering, receiving, holding, or disposing of any Giveaway reward are the sole responsibility of the Participant. We do not provide tax, legal, or financial advice. Where required by law, we may withhold or report payouts.

11. Information We Collect & How We Use It

When you participate in a Giveaway or otherwise interact with the site, we may collect, process, and store information you submit, information generated through your use of the site, and certain technical and security signals. We use this information to administer Giveaways, verify eligibility, detect and prevent bots, fraud, and abuse, communicate with you about your entry or reward, comply with legal and regulatory obligations, and operate, secure, and improve the site.

We do not sell your information. We may share information with service providers, platform partners, and authorities where reasonably necessary to operate the Services or comply with applicable law. Information may be processed and stored in jurisdictions other than your own. We retain information only as long as we believe is reasonably necessary for these purposes or to satisfy legal obligations. 12. Third-Party & Sponsor Disclaimer

Giveaways may reference or involve third-party platforms, services, or sponsors. We are not responsible for any third-party services, platforms, or products. No third party assumes any liability for any Giveaway, and your relationship with any third party is solely between you and that third party.

13. Responsible Conduct

Some content on this site is related to legal-age gambling and adult entertainment. Gambling can be addictive and is not appropriate for everyone. If you or someone you know may have a problem with gambling, please seek help from a qualified gambling-support service in your country. Always play within your means. Nothing in these Terms or any Giveaway is an inducement to gamble.

14. Indemnification

You agree to defend, indemnify, and hold harmless Mitch Jones and his agents, representatives, affiliates, employees, contractors, sponsors, and partners from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your participation in any Giveaway; (b) your breach of these Terms; (c) your violation of any law or third-party right; or (d) any content you submit.

15. Limitation of Liability

To the maximum extent permitted by applicable law, we, our agents, and our affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or opportunity, arising out of or related to any Giveaway, these Terms, or your participation, even if advised of the possibility of such damages.

In no event will our aggregate liability arising out of or related to a Giveaway exceed the greater of (i) the actual value of the reward (if any) delivered to you in that Giveaway, or (ii) one hundred U.S. dollars (USD $100). Some jurisdictions do not allow certain limitations of liability; in such jurisdictions, the foregoing limitations apply to the maximum extent permitted by law.

16. Dispute Resolution & Class Action Waiver

We operate globally and do not designate a single governing jurisdiction in these Terms. The parties intend that any dispute be resolved efficiently and on an individual basis, regardless of where either party is located.

To the maximum extent permitted by applicable law, any dispute, claim, or controversy arising out of or relating to these Terms or any Giveaway shall be resolved exclusively by final and binding individual arbitration, conducted in the English language. The parties shall first attempt in good faith to mutually agree on a reputable, neutral arbitration provider; if no agreement is reached within thirty (30) days of written notice of dispute, the arbitration shall be administered by a recognized international arbitration body of our reasonable selection, in accordance with that provider’s then-current rules. Judgment on the award may be entered in any court of competent jurisdiction.

You and we each waive any right to a jury trial and any right to participate in a class action, collective action, mass action, or representative proceeding. Disputes must be brought only in an individual capacity. If this class-action waiver is held unenforceable, then the entire arbitration provision will be null and void as to the affected claim only, and the remainder of these Terms will remain in full force and effect.

Notwithstanding the foregoing, either party may bring an individual action in any small-claims court of competent jurisdiction for disputes within that court’s jurisdiction, and we may seek injunctive or equitable relief in any court of competent jurisdiction to protect intellectual property or prevent fraud or abuse.

Nothing in this Section is intended to displace any non-waivable rights or protections you may have under the mandatory consumer-protection laws of your country of residence.

17. Time Limit for Claims

Any claim or cause of action arising out of or related to a Giveaway or these Terms must be filed within one (1) year after the claim or cause of action arose, or it is permanently barred, to the maximum extent permitted by law.

By submitting information through this portal or otherwise participating in a Giveaway, you acknowledge that you have read, understood, and agree to these Giveaway Terms & Conditions, including the class-action waiver and arbitration provisions in Section 16.
